Terms and Conditions

Below we publish the terms and conditions of the offerings (programs, courses, classes, workshops and retreats) of Vyana Yoga.

  1. The agreement
    The learning agreement is concluded between the consumer who takes the program, course, workshop, class or retreat (hereinafter “you”) and Vyana Yoga, which provides training. The study contract is formed by your acceptance of the offer by Vyana Yoga (registration) and their confirmation by Vyana Yoga. The Learning Agreement contains the courses to which you subscribe, including teaching materials and the training days associated with the training, programs, courses and retreats. The study agreement applies to the total duration of the training. Vyana Yoga assumes that you will actively take part in the training. Vyana Yoga ensures proper planning and scheduling of training days. You may expect from Vyana Yoga that training at a high level will be offered by qualified instructors, high-quality teaching materials and adequate facilities. Vyana Yoga will endeavour to enable you to complete the program successfully.
  2. Registration and reflection
    By registering for Vyana Yoga’s program, course, workshop, class or retreat a study agreement for the duration of the training is agreed specified in the training and information and you agree with the conditions stated here. If program-specific conditions apply, these are listed in the course information. The training information, such as how to start and curriculum can be found on the website. The services and support arising from the study contract are personal and not transferable. The agreement comes into effect as soon as Vyana Yoga has received your application and Vyana Yoga has sent you a receipt. If the subscription has taken place over the internet, you will receive an automatic confirmation with log-in codes to our Vyana Yoga Member area where you can find the contract; if the subscription has taken place otherwise, we will send you the confirmation by e-mail. There is a reflection period of fourteen days from the moment that we have confirmed the registration to you (right of withdrawal). If you like to use the right of withdrawal within this period you can send us per post or e-mail an unequivocal statement that you want to terminate the agreement. However, would you be doing this from two weeks to one week before the start of the program, course, workshop, class or retreat then we will have to charge 50% of the fees charged in connection with the costs already incurred by us. In the case you like to cancel after 1 week before the event, we cannot refund any money (cancellation). You may delay your course one year without any administrative costs. Upon postponement longer than one year, administrative costs will be charged, this is 20% of the course fee.
  3. Entry
    To be admitted to the programs, workshops, courses, classes and retreats, you need to understand the Dutch or English. Our courses, classes, workshops and retreats are taught in English or Dutch on request. The teaching materials are in English. If prerequisites are required, it is written on our website per program, course, class, retreat or workshop.
  4. Payment and late payment
    The current fees can be found on Vyana Yoga’s website. Payment is via IDEAL, SOFORT, Paypal, Bancontact or Creditcard at once, unless other agreements are made. Vyana Yoga warrant that your tuition is not changed during your studies. You are in payment default at the time the due date has passed. Vyana Yoga will send a payment reminder after the expiration of that date and gives you the opportunity to pay within ten working days of receiving this reminder. If you still have not paid after expiration date of the payment reminder, Vyana Yoga is entitled to charge interest and reasonable costs of (extrajudicial) collection. The interest may be charged from the expiration date of the payment and is equal to the statutory rate. During the handling of a complaint or dispute, Vyana Yoga suspends the charging of interest and recovery costs. If you do not meet the payment obligations agreed with you, Vyana Yoga can temporarily interrupt the course until the arrears in payment has been run. If Vyana Yoga launches a collection procedure, the claim is extended to the entire amount of any outstanding tuition for the current academic year, supplemented by debt collection and other costs, and your study temporarily interrupted. When transferred to a collection agency the given discounts will be cancelled. You shall at all times be responsible for fulfilling your obligation to pay tuition and other costs, even if you have indicated that your employer paying will be paying your tuition. Vyana Yoga is not responsible for the topicality of the study materials if your study has stood by a claim for some time. Then purchasing updated study will be at your expense.
  5. Study and service duration
    The study contract terminates automatically after the expiration of the study as stated in your registration; the mutual rights and obligations cease to exist at the time the study contract ends. If a course or workshop will be cancelled, you can register for a different date if possible. Vyana Yoga reserves the right to make changes in the curriculum or cancel programs, courses, classes, retreats or workshops where too few participants have registered (less than four). At our programs, courses, workshops, treatments and classes the door opens 15 minutes before start time for registration and to change if needed. The door closes five minutes after start time, so that everyone can enjoy the lessons without interruptions.
  6. Teaching materials
    The course materials including additional material sent online from the program for which the fee is paid, you may retain, but not use other than for personal study. Selling or donating teaching materials to third parties is not allowed. The copyright and intellectual property rights of the study are held by Vyana Yoga (where applicable).
  7. Customer service
    Vyana Yoga does, of course, everything to offer the best possible education. Should you have a comment or complaint about the service provided, you can leave your comment or complaint by e-mail submission to us. Vyana Yoga will make every effort to resolve the complaint as soon as possible. The responsibility for the timely and accurate disclosure of your personal information remains with you at all times. For handling questions of an administrative nature or the content of the training we can be reached by e-mail. These questions are answered by Vyana Yoga within ten working days from the date of receipt. For questions that require a longer processing time, Vyana Yoga will answer with a message of receipt within 48 hours and an indication when to expect an answer.
  8. Governing Law and Liability
    The study contract is governed by Dutch law. Insofar Vyana Yoga is imputably and you suffer harm as a result, Vyana Yoga’s liability is limited to compensation for direct damage. Massage and yoga are not a substitute for medical examination or treatment. You are responsible for seeking the advice of a physician or other qualified health care taker for mental and / or physical ailments. Before starting the yoga or massage treatment, course, program, workshop, class or retreat you should let us know about your medical situation. You are responsible to pass on changes in your medical situation in time, so we can keep track of your medical records. You understand that there will be no liability on the part of Vyana Yoga if you have not given us your updated medical situation on time. Vyana Yoga is not responsible for personal injury or property damage resulting from one of its services.
  9. Personal Data Protection Act
    In the context of the Data Protection Act, the information you provide, such as name and (e-mail)address, is included in our records. Vyana Yoga will only use your information to keep you informed about the training of Vyana Yoga or related information. If you have an objection to this use of your data, you can do it in writing or via e-mail to let Vyana Yoga know. Vyana Yoga does not sell personal information to third parties.   10. Suspension
    Vyana Yoga reserves the right to refuse, suspend and/or remove students in special circumstances. This applies to students who commit fraudulent acts or acting outside the social norm and become aggressive or violent behaviour fitting in communication, by phone or digital or persona.
  11. Change of conditions
    Unless otherwise agreed in writing, the terms and conditions may be changed by Vyana Yoga. Vyana Yoga will publish changes at least two weeks before the effective date on Vyana Yoga’s website.

This is the privacy statement of Vyana yoga. Here we describe how we handle your personal information, which is collected by Vyana yoga.

This privacy statement explains how we collect and handle your personal information. We explain where we store your information and why we do this. We also inform you of your rights concerning your information and how you can use those rights. The privacy statement will sometimes be changed by, for example, legislative changes.     You are currently reading the privacy statement of Vyana yoga. Vyana yoga is a one-man company focused on teaching yoga and massage, in the form of group yoga lessons, individual yoga and massage sessions and workshops. There are situations where your data is collected by Vyana yoga. It is therefore good that you know what is being done with, and how you can indicate your wishes about your data.   2. Purpose data
    Personal data is collected by Vyana yoga for a number of purposes. These are explained below.
    01. Sending newsletters
    Vyana yoga sends out newsletters via e-mail. These newsletters are on the one hand commercial and on the other hand focused on sharing knowledge. Your name and e-mail address are collected via the appropriate form on the Vyana yoga website. In addition, you can be asked orally or textually to sign up.
    02. Intake form
    The usage of an intake form is mandatory to be able provide proper services. This form will form your ‘file’ and contains relevant notes about your health and progress of the sessions with regard to the goal that is stated on the form. Vyana yoga is has exclusive access to the information on this form, to which duty of confidentiality applies.
    03. Contact us
    Your data will be collected when you contact Vyana yoga through the website. This form, however, only asks for the necessary information to be able to offer a proposal or a service, such as your name, company name, e-mail address, telephone number and project description.
    04. Analytics
    The website of Vyana yoga collects your data to improve the website. This is done with Google Analytics. These data are anonymous and are therefore not tied to your personal data. Think of information such as the duration of your website visit or the pages you visit a lot. All data will only be processed with your explicit permission or to execute the agreements that are entered into, or because processing is necessary to bring you into contact with potential customers and / or contractors.
    05. Cookies
    Vyana Yoga uses functional, analytical and tracking cookies. A cookie is a small text file thatis stored in the browser of your computer, tablet or smartphone when you first visit this website.     The data received and processed by Vyana yoga are managed by:
    01. Mailchimp
    The newsletters are sent with Mailchimp. The moment you sign up for the newsletter, your e-mail address and first name will automatically be saved in the appropriate list within Mailchimp.
    02. iCloud drive
    The intake form will will be stored on iCloud drive. click on the link to view their privacy policy.
    03. Transip
    The e-mail from Vyana yoga is hosted by Transip. If you contact us via the forms or via e-mail, these e-mails will be stored on the TransIP servers.
    04. Social media
    Vyana yoga uses various social media platforms such as: Facebook, Instagram, Youtube, Vimeo, Soundcloud, Linkedin. Click on the relevant platform to go to their privacy statement.
  4. Storage period
    Your data will be retained for a longer period of time by Vyana yoga, but never longer than is necessary for carrying out activities, unless we have to keep your data for longer because of a statutory regulation.
    01. Sending newsletters
    Your e-mail address, name, phone number, IP address and preferences are stored in Mailchimp. The storage of your data is for an indefinite period of time. You can unsubscribe whenever you want via the link at the bottom of the newsletters or by sending an email to info@vyanayoga.nl
    02. Intake form
    The information and notes that are recorded on the intake form will be stored on the iCloud drive during our collaboration up to a year after the last session.
    03. Contact us
    The moment you contact Vyana yoga via e-mail, the data you send, such as your name, company name, and e-mail address, will be stored on the mail server. Those e-mails will be saved up to a maximum of two years.
    04. Analytics
    The data that Analytics collects on the website is anonymous, so it is not linked to your name, company or e-mail address. This data is stored indefinitely within Google Analytics.
  5. Security
    No physical copies of your personal data will be made. Your data is only managed in the aforementioned systems and software.The personal data managed by Vyana yoga or by previously mentioned third parties can only be accessed via the above software and protected by a password and where possible with two-step verification.In this two-step verification, a code is generated from the software and sent to Vyana yoga. This code must be used during the login process.The devices that open your data are each also locked with a password and / or fingerprint. The number of devices that have access to your data is limited to the necessary devices only. In addition, your visit to our website is secured by an SSL certificate. This means that your connection to the Vyana yoga website is private. You recognize this security by the green lock before the url.
  6. Your rights
    01. Right of access
    You have the right to request your data that are recorded and saved with Vyana yoga at all times. You do this by sending an e-mail or by calling Vyana yoga. You will then receive an overview of your data.
    02. Right to rectification
    Are your data not correct? Or have your data changed? You have the right to have this rectified by Vyana yoga. You can adjust your data about the newsletter via the appropriate url at the bottom of each email.
    03. Right to transfer
    In case you switch to another party or service and you need the data stored with Vyana yoga, then you have the right to transfer. Vyana yoga then has to transfer all your data to the other party.
    04. Right to erase data
    Do you no longer want your data to be recorded with Vyana yoga? Then you have the right to have your data deleted.
    05. Right to submit a complaint
    You have the right to file a complaint with the Dutch Personal Data Authority, if you think that Vyana yoga does not handle your data correctly. This can be done via this link.
    06. Right to stop data use (objection)
    Do not you want Vyana yoga to use your data? Then you have the right to stop the use of your personal data. You can exercise these rights by sending an email to info@vyanayoga.nl with a copy of your ID where the photo, numbers at the bottom of the passport, ID-number and social security number are unreadable. The aim is to respond within a month.
  7. Obligations
    Vyana yoga processes personal data on the basis of a legitimate interest, namely a commercial interest. Think of offering services or products from Vyana yoga via e-mail. Your details will never be sold to third parties.The data that are mandatory to deliver are the minimum required data for the provision of the services or products. Your e-mail address, for example, is required to be able to send the newsletter. If this mandatory information is not provided, Vyana yoga cannot offer the relevant service.If it is necessary to share data that you have shared with Vyana yoga, with others than the aforementioned parties (for example, offering a service), your permission will first be requested. Vyana yoga reserves the right to disclose the data when legally required or when Vyana yoga deems it justified to comply with a legal request / process or to protect the rights, property or safety of Vyana yoga.
